Terms of Use & SMS Terms

The agreement between you and [SENSITIVE] covering this website, the client portal, and our text messaging program. Written to be read, not to be skipped.

The Agreement

Acceptance of These Terms

These Terms of Use (“Terms”) are a binding agreement between you and Oakhaus LLC, a Missouri limited liability company doing business as [SENSITIVE]. They govern your use of oakhaushomes.com, the Oakhaus client portal, and every email and text message we send through them (together, the “Services”).

Oakhaus LLC is not a real estate brokerage. Real estate brokerage services are provided by Jose Harrison, a licensed missouri real estate salesperson (License #2017002965), affiliated with Keller Williams Local (License #2003023935), 1619 E. Independence St., Springfield, MO 65804, (417) 883-4900. Each office is independently owned and operated.

By using the Services, creating an account, or opting in to text messages, you accept these Terms and our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Services.

You must be at least 18 years old and able to form a binding contract to use the Services.

This Is Not an Agency Agreement

Using this website, creating a portal account, or exchanging messages with us does not create an agency relationship. Under Missouri law, an agency relationship is established only by a signed written brokerage agreement — and that agreement is with Keller Williams Local, the sponsoring broker, not with Oakhaus LLC. Until you sign one, we are not your agent and owe you no fiduciary duties.

Text Messaging

SMS Terms & Conditions

These SMS Terms govern the Oakhaus LLC text messaging programs. We run two of them — informational and marketing — and you consent to each one separately, by checking its own box. By providing your mobile number and checking a consent box, you expressly consent to receive that category of text message from Oakhaus LLC at that number, including messages sent using an automatic telephone dialing system. Neither consent is a condition of any purchase, and consenting to informational messages does not consent you to marketing messages.

Two Separate Programs

Oakhaus LLC operates two text messaging programs, and you consent to them separately. INFORMATIONAL: showing and appointment confirmations, updates during an active transaction, document requests, account and security notices, and direct replies from your Oakhaus agent. MARKETING: new listings matching your saved search, price-change alerts on homes you follow, and market reports. Agreeing to one does not agree you to the other.

How You Opt In

Each program has its own checkbox, and neither is ever pre-checked. You may check either, both, or neither. The consent language for that program always appears next to its checkbox. You can opt in when you register for the client portal, complete portal onboarding, ask about a listing, or submit the contact form. Neither consent is a condition of purchasing any property, product, or service from Oakhaus LLC, and you never have to accept marketing messages in order to receive information about a property you asked about. You must be 18 or older and the authorized subscriber or customary user of the mobile number you provide.

Message Frequency

Message frequency varies. Frequency depends on your saved searches, market activity, and whether you are in an active transaction. Most clients receive between 2 and 10 messages per month; clients under contract may receive more while their transaction is in progress.

Cost

Message and data rates may apply. Oakhaus LLC does not charge you for text messages, but your mobile carrier may charge you for messages sent and received according to your plan. Contact your carrier for details about your plan.

Carrier Liability

Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier and is outside of our control. Supported carriers include AT&T, Verizon Wireless, T-Mobile, and most other US wireless carriers; carriers are not required to support the program.

Opt Out — Reply STOP

You can cancel the SMS service at any time. Simply text STOP to the number from which you received the message. (STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT also work.)

After you send us the message, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive messages from us. If you want to rejoin, just sign up again as you did the first time and we will start sending messages to you again.

You may also disable SMS at any time in your portal account settings.

Help — Reply HELP

If you are experiencing issues with the messaging program, reply with the keyword HELP for more assistance, or get help directly at harrison@oakhausland.com or [SENSITIVE].

Replying HELP returns our contact information and a reminder of how to opt out. Message and data rates may apply.

Privacy of Your Mobile Information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We may modify or terminate the messaging program at any time, for any reason, with or without notice. We may also change the short code or phone number from which messages are sent, and we will notify you if we do.

Your Account

Client Portal Accounts

Accurate Information

You agree to provide true, current, and complete information when you register, and to keep it updated. Providing a mobile number you are not authorized to use is a breach of these Terms.

Account Security

You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you suspect unauthorized access.

Suspension & Deletion

We may suspend or terminate an account that violates these Terms. You may delete your account at any time from account settings, or by emailing us.

IDX & MLS

Listing Data & Property Information

Listing information displayed on this site comes in part from the Internet Data Exchange (IDX) program of MARIS MLS. IDX information is provided exclusively for consumers' personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing.

Listings are subject to prior sale, change, or withdrawal at any time. Information is deemed reliable but is not guaranteed accurate by the MLS or by Oakhaus. Square footage, lot size, acreage, school assignments, flood zone status, taxes, and HOA information are provided by third parties and should be independently verified by you or your professional advisors before you rely on them.

Market reports, valuations, and CMAs on this site are estimates generated from available market data. They are not appraisals, and they are not a guarantee of value or of any sale price.

Rules

Acceptable Use

You may use the Services for your own lawful, personal, non-commercial real estate purposes. You may not:

Scrape, crawl, harvest, or bulk-download listing data, photographs, or any other content from this site.

Use listing data for any purpose other than your personal, non-commercial search for real estate.

Attempt to access another user's portal account, documents, or messages.

Probe, scan, or test the vulnerability of the site, or bypass any authentication or rate limit.

Upload malware, or upload content you do not have the right to share.

Use the site or our messaging program to send unsolicited commercial messages, or to harass anyone.

Misrepresent your identity, or provide a mobile number you are not authorized to use.

Reverse engineer, frame, or create derivative works from any part of the site.

Ownership

Intellectual Property

The Oakhaus name, logo, design, written guides, market commentary, photography, and code on this site are owned by [SENSITIVE] or its licensors and are protected by copyright and trademark law. Listing content and photographs remain the property of the listing brokerage or MLS. You may view and print content for your personal, non-commercial use. Any other reproduction, distribution, or commercial use requires our prior written permission.

No Warranties

Disclaimers

Service Provided "As Is"

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

Message Delivery

We do not guarantee that any text message or email will be delivered, delivered on time, or delivered to the correct device. Carriers are not liable for delayed or undelivered messages. Do not rely on a text message as your only notice of a time-sensitive event — deadlines in a real estate transaction are governed by your contract, not by our alerts.

Not Legal, Tax, or Financial Advice

Content on this site — including guides, calculators, market reports, and mortgage estimates — is for general information only. It is not legal, tax, financial, or appraisal advice. Consult a licensed attorney, tax professional, lender, or appraiser about your specific situation.

Third-Party Links

We link to third-party sites (lenders, inspectors, government resources) as a convenience. We do not control them, do not endorse their content, and are not responsible for their privacy practices or their services.

Limits

Limitation of Liability & Indemnity

To the fullest extent permitted by Missouri law, [SENSITIVE] and its agents, employees, and vendors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the Services — including any damages arising from a delayed, undelivered, or misdirected text message or email.

Our total liability for any claim arising out of the Services is limited to one hundred dollars ($100.00) or the amount you paid us for use of the Services in the twelve months before the claim, whichever is greater. This limit does not apply to obligations arising under a signed brokerage agreement between you and Keller Williams Local, or to liability that cannot be limited by law.

You agree to indemnify and hold harmless [SENSITIVE] from any claim arising out of your misuse of the Services, your violation of these Terms, or your violation of the rights of any third party — including any claim arising from your having provided a mobile number you were not authorized to use.

Jurisdiction

Governing Law & Disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws rules. Any dispute arising out of these Terms or the Services will be brought exclusively in the state or federal courts located in Pulaski County, Missouri, and you consent to their jurisdiction.

If any provision of these Terms is found unenforceable, the rest remain in full force. Our failure to enforce a provision is not a waiver of it.

Updates

Changes to These Terms

We may revise these Terms from time to time. The effective date at the top of this page tells you when they last changed. If we make a material change — particularly to the SMS Terms — we will notify you by email or through the portal before it takes effect. Continuing to use the Services after a change means you accept the revised Terms.
